FFWD Production – Activ Park

Article 1 – Purpose

These General Terms and Conditions of Sale and Activity Organisation (hereinafter referred to as the “Terms and Conditions”) govern all contractual relationships between FFWD Production – Activ Park (hereinafter referred to as the “Organiser”) and any natural or legal person booking one or more activities (hereinafter referred to as the “Client”).

Any reservation implies the full, unconditional and irrevocable acceptance of these Terms and Conditions as well as the internal rules of the site.

Article 2 – Scope of Application

These Terms and Conditions apply to all reservations made:

  • via the website

  • by email

  • or by any other means accepted by the Organiser

They prevail over any other terms or documents issued by the Client, unless otherwise agreed in writing.

Article 3 – Reservation and Confirmation

Reservations may only be made:

  • via the website

  • by email

For activities scheduled within less than 48 hours, reservations must be made via WhatsApp.

A reservation shall only be considered final and confirmed once the full payment or the requested deposit has been received.

The Organiser reserves the right to refuse any incomplete or unpaid reservation.

Article 4 – Group Organiser

The person making the reservation shall automatically be considered the group organiser and responsible person for the group.

This organiser is the sole contact person for the Organiser and undertakes to:

  • inform all participants of these Terms and Conditions and the internal rules

  • ensure that they are respected

  • ensure that all participants comply with safety instructions and staff directions

  • remain present during the entire duration of the activity

  • be responsible for the behaviour of all participants throughout the activity

The group organiser is responsible for the conduct of all participants registered under the reservation.

In the event of damage to equipment, infrastructure or facilities, or in case of dangerous, inappropriate or non-compliant behaviour, the group organiser may be held responsible for the actions of the participants of the group and for any resulting financial consequences.

The Organiser reserves the right to immediately exclude any person whose behaviour endangers the safety of participants, staff or facilities, without any right to a refund.

The group organiser may subsequently take action against the participant responsible for the incident. For this purpose, the organiser may be required to provide the necessary contact details and information regarding the participant concerned in the context of a complaint or legal procedure.

Article 5 – Number of Participants

The group organiser undertakes to communicate the final number of participants no later than 5 working days before the activity.

Failing this, the Organiser reserves the right to invoice the services based on the number initially reserved.

In case of absence not communicated within the required timeframe, no refund or price reduction will be granted.

Article 6 – Prices and Special Conditions

Unless otherwise stated, offers apply to groups of a minimum of 10 participants.

Below this number, a fixed group rate may apply.

Any modification to a standard programme may result in additional charges.

Article 7 – Payment Terms

Invoices are payable immediately.

In certain cases, a deposit may be required.
The balance must then be paid on the day of the activity in a single payment by the group organiser.

Accepted payment methods are communicated during the reservation process.

In case of late payment, the following shall automatically apply without prior notice:

  • a fixed compensation of 15% of the amount due, with a minimum of €50

  • late payment interest of 15% per year

  • administrative costs of €12.50

Article 8 – Cancellation and No-Show

Any cancellation must be communicated by email with acknowledgment of receipt.

The following conditions apply:

Up to 16 days before the activity
free cancellation, reimbursement exclusively in the form of a voucher, minus 15% administrative costs

Between the 15th and the 6th day before the activity
50% of the total amount will be retained as compensation

From the 5th day before the activity
100% of the total amount is due

In the event of a group not showing up or cancelling late, the full activity will be charged.

Responsibility Related to Travel and Participant Attendance

The Organiser shall not be held responsible if one or more participants are unable to travel to the activity location for reasons beyond its control, including but not limited to:

  • adverse weather conditions

  • traffic difficulties

  • vehicle breakdowns

  • transport issues

  • strikes

  • accidents

  • or any other event preventing participants from travelling

In such cases, the above cancellation conditions remain fully applicable.

Cancellation of a group reservation cannot be accepted due to an individual circumstance affecting one or more participants (such as illness, accident, death or personal circumstances).

Article 9 – Force Majeure

The Organiser shall not be held liable in the event of cancellation or modification of an activity resulting from a force majeure event, including but not limited to:

  • natural disasters

  • extreme weather conditions

  • administrative or governmental decisions

  • strikes

  • epidemics

  • or any event beyond the Organiser’s control

In such cases, any amounts already paid will be converted into a voucher valid for a future activity.

Article 10 – Organisation and Conduct of Activities

The Organiser is bound by an obligation of means and not an obligation of result.

Each participant acknowledges that participation in activities involves inherent risks and undertakes to strictly comply with safety instructions and staff directions.

The Organiser reserves the right to refuse access to an activity or interrupt an activity for any person who:

  • fails to comply with instructions

  • behaves in a dangerous or inappropriate manner

  • is under the influence of alcohol or drugs

This shall not give rise to any refund.

In case of late arrival of the group, the duration of the activity may be shortened in order to respect the reservation schedule. No refund or extension will be granted.

Alcohol and Participant Behaviour

Excessive alcohol consumption before or during activities is strictly prohibited.

The Organiser reserves the right to refuse access to an activity or immediately exclude any participant who appears intoxicated or whose behaviour is dangerous or aggressive.

Such exclusion shall not entitle the participant or the group to any refund, compensation or rescheduling.

If the behaviour of one or more participants compromises the safety or proper organisation of the activity, the Organiser reserves the right to terminate the activity for the entire group.

In such cases, no refund shall be granted.

The group organiser remains responsible for the behaviour of the participants registered under the reservation.

Article 11 – Liability Waiver

Participation in activities is subject to the mandatory signing of a liability waiver by each participant.

Failure to sign this document may result in the refusal of access to the activity without any right to a refund.

The group organiser is responsible for collecting all required signatures.

Article 12 – Liability

The Organiser shall not be held liable for damages resulting from:

  • failure to comply with instructions

  • improper use of equipment

  • incompatibility between the activity and the health condition of a participant

To the maximum extent permitted by law, the liability of the Organiser shall be limited to the amount actually paid for the activity concerned.

Article 13 – Material Damage

Any damage caused to infrastructure, installations or equipment will be invoiced to the group organiser.

If such damage prevents the normal operation of the site, additional compensation may be claimed.

Article 14 – Personal Belongings

The Organiser declines any responsibility for loss, theft or damage to personal belongings, including in lockers or in the parking area.

Lost items will be kept for a maximum period of 7 days.

Article 15 – Discounts and Offers

Any discount, gift voucher or promotional offer must be mentioned at the time of reservation.

No discount will be granted on site.

Offers cannot be combined.

Article 16 – Personal Data

Personal data collected during a reservation or contact request are processed in accordance with the General Data Protection Regulation (GDPR).

These data are used solely for reservation management and customer relations.

The Organiser may occasionally send information, news or promotional offers relating to its activities.

Personal data are never sold or transferred to third parties for commercial purposes.

Each person has the right to access, rectify, object to and request the deletion of their personal data.

An unsubscribe link is included in every communication.

Article 17 – Applicable Law and Jurisdiction

Complaints and Online Reviews

Any complaint regarding an activity must be communicated to the Organiser within a reasonable period after the activity in order to allow an analysis of the situation and, where appropriate, the search for an amicable solution.

Online reviews must reflect a genuine and truthful experience.

Any attempt to exert pressure, threats or blackmail in order to obtain a refund, discount or advantage in exchange for the modification, deletion or non-publication of a negative review may result in appropriate measures and, where applicable, legal action.

Jurisdiction

These Terms and Conditions are governed by Belgian law.

Any dispute shall fall under the exclusive jurisdiction of the courts of Verviers.

The reference language of these Terms and Conditions is French.

Article 18 – Acceptance of the Terms and Conditions

Any reservation implies full and unconditional acceptance of these Terms and Conditions.

This acceptance is confirmed:

  • when booking online by ticking the dedicated acceptance box

  • when booking via email or message (including WhatsApp) by confirming the reservation

The Client acknowledges having read these Terms and Conditions prior to making a reservation and undertakes to communicate them to all participants of the group.
